Terms and Conditions

The Owner hereby agrees to the following Terms and Conditions covering the hire of the Vehicle described above:-

• To insure the Vehicle for use by the Hirer under cover of a fully comprehensive policy for the Period of Hire and to make available for inspection by the Hirer the Terms of such Policy.
• To issue the Vehicle only if the Road Fund Licence is current and prepaid up to a date coinciding with or beyond the end of the period of hire.
• To issue the Vehicle in a well maintained, roadworthy and safe condition.

The Hirer hereby agrees to the following Terms and Conditions of hire of the Vehicle:-

• To pay the hire fee in advance prior to the commencement of the Period of Hire.
• To produce to the Owner for his inspection, a current driving licence.
• To return to the Owner, the Vehicle in the same condition as at the commencement of hire (excluding reasonable wear and tear) and to reimburse the Owner for the cost of repairing and making good any damage caused during the Period of Hire not recoverable under the insurance policy specified in Paragraph 2a above. (A copy of Terms of such policy is available from the Owner).

General Conditions

• The Hirer will return the Vehicle by the time and date indicated in Paragraph 1, or sooner if required by the Owner.
• In the event that the Owner demands the return of the Vehicle prior to the termination date specified in Paragraph 1, the Hirer will be reimbursed for the hire charge covering the period of hire for which the Vehicle has not been used, except where the owner recalls the Vehicle because of a breach of this agreement by the Hirer.
• In the event that the Hirer returns the Vehicle to the Owner prior to the time and date specified in Paragraph 1, no refund of the prepaid hire charge will be made unless the Hirer satisfies the provision in Paragraph 2.
• The Hirer will return the Vehicle to the address of the Owner as specified in Paragraph 1.
• The cost of petrol consumed during the hire will be borne by the Hirer in full.
• The Hirer will pay all fines, court costs and other expenses for parking, traffic and other violations with respect to the use of the Vehicle during the Period of Hire, unless such costs are incurred as the direct result of the Owner not fulfilling the Terms and Conditions of this agreement.
• The Hirer will only use the Vehicle for his social, domestic and pleasure purposes, or for conveyance to and from his place of work excluding use for the conveyance of passengers or goods for hire or reward, and also excluding use for racing, pace making or speed testing, or for any illegal purposes.
• The Hirer will be responsible for the full amount of any damage if such damage is caused whilst violating any of the Terms and Conditions of this agreement, or if the Vehicle is abused or driven recklessly or driven whilst under the influence of alcohol or drugs.
• The Owner can repossess the Vehicle if the Vehicle is found illegally parked or being used to violate the law or this Agreement, or if the Vehicle appears to be abandoned, or if the Owner discovers that the Hirer made a misrepresentation to obtain the Vehicle. The Owner need not give advance notice under these circumstances.
• All charges, fee and expenses including payment for loss of or damage to the Vehicle are due to the Owner on his demand.
• The Owner will not be responsible for loss or damage to any property left at any time on the Vehicle on the Owner's premises.
• At all times during the Period of Hire the Vehicle will remain the property of the Owner.
• The Hirer will notify the Owner immediately in the event of anything happening to the Vehicle such as theft, fire or damage whether accidental or not.
• The Vehicle may only be driven by the Hirer on the United Kingdom mainland.
• The Owner will take no responsibility for breakdowns or mechanical failure of the Vehicle.
• The Hirer hereby acknowledges that this Agreement shall extend to any other Vehicle let to him under the same hire agreement, and to any period by which the original Period of Hire may be extended.
